Detailed Rules for Creator Account Registration and Identity Verification

The detailed rules for Creator Account registration and identity verification are specified in the Rules for Creator Registration on buycoffee.to, available at: buycoffee.to/rules/registration.

§1 General Provisions

This document specifies the rules for registering a Creator Account in the buycoffee.to Service and serves as a supplement to the regulations applicable to Coffee Media sp. z o.o., with its registered office in Wrocław (KRS number: 0000871091): a. Terms of Use for the website buycoffee.to, available at: buycoffee.to/rules/service. b. Payment services regulations for Creators, available at: buycoffee.to/rules/payments. c. Community guidelines for buycoffee.to, available at: buycoffee.to/rules/guidelines.
Undefined terms in these Rules have the meaning assigned to them in the regulations mentioned in point 1 above.

§2 Activation of a Limited Creator Account

The Company allows Creators to use a limited Creator Account for a period of 30 days from the date of concluding an agreement with the Company under the terms specified in the Terms of Use for the website buycoffee.to. The limited Creator Account allows receiving Support payments up to a maximum amount of 4000 PLN within 30 days from the agreement date. To use the Creator Account, acceptance of the Terms of Use is required. By registering, the User confirms they have read, understood, and agreed to the Terms of Use and Privacy Policy and commits to adhering to their provisions and the rights and obligations arising from them.
For the activation of a limited Creator Account, the User must provide the following data:
1. For an individual User:
  1. First and last name,
  2. Residential address,
  3. Email address,
  4. URL referring to the User's Activity.
2. For a Creator that is a legal entity or an organizational unit without legal personality:
  1. First and last name of representatives,
  2. Declarations regarding politically exposed person status of representatives,
  3. Name of the entity,
  4. Address of the entity's registered office or business address,
  5. Tax identification number (NIP), or, if unavailable, the country of registration, name of the relevant registry, and registration number and date,
  6. Declaration about actual beneficiaries,
  7. URL referring to the User's Activity,
  8. Email address,
  9. User's bank account number.
Information about the User (legal entities or organizational units) is retrieved by the Company from publicly available databases such as the electronic KRS or GUS systems.
After receiving and verifying the User's data, the Company activates a limited Creator Account with a Support limit of 4000 PLN for up to 30 days from the agreement date. The Creator gains access to the Creator Account functionalities and acquiring services, and the Company will process Transactions up to 4000 PLN during this period.

§3 Creator Account

After exceeding the limits or the time specified in §2.4, the Company will block the Creator's ability to receive Support and send a notification requesting additional identification details:
1. For individual Creators:
  1. Bank account number,
  2. Phone number.

§4 Identity Verification for Creators

Identity verification for Creators involves confirming the provided identification data using a valid identification document for individuals, current registry data for entities, or other reliable and independent sources. This may include services involving photo ID submission and video identity verification. Verification can be conducted at any time using the functionality available in the buycoffee.to Service. In particular, the Company may use services based on sharing a photo of an identity document, video identity verification and verification using the mObywatel application. The technical support of the process of verifying the identity of users using the mObywatel application is carried out by Identt Sp. z o.o., acting as a personal data processing entity on the basis of an agreement on entrusting the processing of personal data concluded with Coffee Media Sp. z o.o. in accordance with Article 28 of the RODO.
The Company conducts Creator verification in the situations outlined in §3 above.
As part of the KYC Procedure, the Company may request additional explanations, information, or documents from the Creator. If the Creator fails to provide the requested information within the specified deadline, including failing to respond to email requests for data completion, the Company reserves the right to refuse Transactions or terminate the Agreement with immediate effect in the event of negative verification.
After providing complete identification data and successful verification, the Company will lift the Support limit of 4000 PLN.
Company staff verify the data provided by the User each time. Providing false data, using someone else's data, or falsifying information to use the Service may result in criminal and civil liability in accordance with applicable laws.
The Company’s internal regulations, including its Anti-Money Laundering and Counter-Terrorism Financing Policy, govern detailed procedures related to verification, identification, and financial security measures for Creators.

§5 Final Provisions

Each Creator may only have one Account registered using accurate data. A single Account may link multiple URLs for payment processing. Any misuse will result in verification and potential Account suspension in case of violations.
Users may use a username specified during registration. Usernames must not be vulgar, offensive, violate good practices, laws, or the Company’s internal regulations mentioned in §1.1.
For a Creator under 18 years of age but over 13, parental or legal guardian consent is required to register a Creator Account. The Company reserves the right to verify such consent.
